A tenant from hell with a track record of bounced cheques and eviction notices has been warned by a Superior Court judge to pay what she owes or expect to face consequences in court.

Nina Willis made a brief appearance at Osgoode Hall courts Wednesday. She is appealing an eviction order issued by the Landlord and Tenant Board after she failed to pay rent.

“You have the right to prosecute an appeal but not to withhold your rent,” said Justice Herman Wilton-Siegel, after granting an adjournment to allow Willis time to obtain a lawyer and pay her landlord the $8,250 she owes him.

“The circumstances before the court when it hears this matter will be completely different depending on whether you pay your rent,” he said.

Willis, who habitually fails to pay her landlords and abuses protections at the Landlord and Tenant Board to delay her evictions, was the subject of a Star investigation in early May. She has been living inside a home in Don Mills since August, failing to pay rent to landlord Darius Vakili for many of those months.

Wednesday’s hearing was adjourned after Willis alleged a “conflict of interest” in part because Vakili’s lawyer, David Strashin, represented three of her previous landlords. Vakili is attempting to have her appeal quashed.

Wilton-Siegel gave Willis the time to get legal advice but strongly cautioned she “can’t simply come into court” and make allegations. He said she needs to be prepared to present a recognized legal argument when she returns to court.

Willis, dressed in a tidy white dress and grey jacket, said “I want to get a lawyer. I’ll pay for (the lawyer) and I’ll pay Mr. Vakili.”

Willis typically loses her cases in front of the Landlord and Tenant Board and often appeals the board decision, resulting in an appearance before an appeals court.

The Star had to use court records and interviews with past landlords and lawyers to confirm Willis has been ordered out of at least six homes since 2005.

Board hearings are open to the public, but unlike cases before the courts privacy legislation means landlords have no access to previous decisions.

Willis is scheduled to appear at Osgoode Hall on June 7th.

big deal!!

-the judge can "order" all they want.......ontario tenants don HAVE to pay rent. Yes eventually they will be evicted, but this inofrmation is kept hidden from landlords by the ontario landlord tenant board......and the chances of the landlord ever collecting any of the money owed is very slim.

THAT is the reality in ontario.

There is an update in todays Star about this story. She has til the 21st of June now. It will be interesting to watch how it pans out. Can't understand why there are no comments. Not even a way to comment.

Justice Thea Herman said there was “no dispute” Willis has failed to pay rent, but it wasn’t clear if her appeal was “utterly devoid of merit.”

Herman told Willis to pay $8,250 by June 21, by certified cheque or money order to her landlord’s lawyer, David Strashin. She must also pay $1,650 rent each month. Failure to do one or both means Strashin can have her appeal quashed.

“Ms Willis has the right to appeal but she does not have the right to live rent-free pending the appeal,” said Herman.

Last week, a hearing arranged to examine the validity of Willis’s appeal was adjourned. Willis had alleged a “conflict of interest” in part because Strashin represented three of her previous landlords.

At that hearing, Justice Herman Wilton-Siegel warned she must pay $8,250 to Vakili and present a recognized legal argument by Thursday or face consequences in court.

Willis promised to pay and said she intended to get a lawyer.

By Thursday she had failed to make any payments and arrived at court alone.

Strashin said, in his experience, Willis uses protections at the board and delays evictions in court as “long as she possibly can” without paying rent. If she finds a new home she stops coming to court, he said.

“No appeal she has ever filed has been prosecuted beyond this stage,” he said.

Willis blamed missing the deadline on Strashin not delivering documentation, media attention and the cost of preparing for a preliminary hearing for fraud charges, or allegations she provided bad cheques and faked employment information.

Willis also said she was “amongst the situation at the Eaton Centre,” alluding to a fatal shooting that took place in a food court on Saturday, June 2, and lost work days as a result.

I cant say this any more clearly..................ontario tenants do NOT have to pay their rent.

Our rental laws encourage tenants to not pay their rent.

Any judge who thinks otherwise is clearly delusional.

Former TCHC board member Giorgio Mammoliti also found this to be true.

Outgoing board (TCHC) member Giorgio Mammoliti told the Sun it appears to be a free-for-all when it comes to paying rent.

“We have basically educated our tenants in letting them know they don’t need to pay rent,” Mammoliti said.

Aaaannnnddd another update! She paid the back rent and july, but didn't pay august. I am just shocked, I tell you...shocked, that she didn't pay up. (((sarcasm)))

-a lying cheating thief??

there are LOTS more like her out there just waiting to screw another small landlord. She is just the tip of the iceberg.
